NOTICE OF PROPOSED DEVELOPMENT COST CHARGES LAW AND INVITATION TO MAKE REPRESENTATIONS

NOTICE IS GIVEN, pursuant to section 6 of the First Nations Fiscal Management Act (Canada) (hereafter referred to as the “FNFMA”), that the Penticton Indian Band (“The First Nation”) proposes to enact the Penticton Indian Band Development Cost Charges Law, 2018 (hereafter referred to as the “Proposed Law”).

DESCRIPTION OF PROPOSED LAWS: Chief and Council have adopted a long-term capital plan dated February 2, 2018. To help finance the capital infrastructure expenditure program in the plan, the Proposed Law will establish on Penticton Indian Band IR # 1, a system of development levies to be imposed on new development at the time of the issuing of building permits, subdivision approval, or development approval, including providing for the amount of levies to be imposed on different types of development. The Proposed Law will be enacted further to sub-paragraph 5(1)(a)(v) of the FNFMA. The Proposed Law establishes defined areas in the reserve where the Proposed Law will apply. The Proposed Law also provides for the possibility of agreements with developers to obtain credits in regard to development cost charges otherwise payable under the Proposed Law where developers provide capital improvements that advance the goals of the long-term capital plan. The Proposed Law also provides for a complaint procedure where a developer believes that the calculation of development levies for a particular development was made in error.

COUNCIL OF THE FIRST NATION INVITES WRITTEN REPRESENTATIONS regarding the Proposed Law for the next 30 days as set out below:

  • Representations should be made on or before 4 pm, March 23, 2018 in order to ensure consideration by Council.  Before making the Proposed Law, Council will consider all written representations received in accordance with this Notice.
