Notice: Consultation on a proposal for a tobacco cost recovery framework

The Tobacco and Vaping Products Act (TVPA) regulates the manufacture, sale, labelling and promotion of tobacco and vaping products sold in Canada. The TVPA and its regulations are a key component in advancing the government of Canada's Tobacco Strategy to protect people in Canada from tobacco-related death and disease.

Legislative amendments to the TVPA were introduced in Parliament through the Fall Economic Statement Implementation Act, 2023 (Bill C-59), which received Royal Assent on June 20, 2024. These amendments authorize, among other things, the making of regulations respecting fees or charges to be paid by tobacco and vaping product manufacturers for the purpose of recovering the costs incurred by the Government of Canada in relation to carrying out the purpose of the TVPA. It also provides new authorities under the TVPA for related compliance measures to administer and enforce the tobacco and vaping cost recovery frameworks. At this time, Health Canada is only advancing the development of a tobacco cost recovery framework.

 

Health Canada is currently seeking feedback on the proposed approach to recovering federal government costs for certain tobacco-related activities. This consultation process will run for 70-days from August 1, 2024 to October 10, 2024.

The Government of Canada recognizes the sacred and ceremonial role that traditional tobacco has for many First Nations and Métis Peoples which differs from the use of commercial tobacco. It is also recognized that the manufacture and sale of commercial tobacco plays an economic role in certain communities. Health Canada would like to learn of any impacts the development and implementation of this cost recovery framework may have on Indigenous Peoples and communities.

Health Canada welcomes the views of Indigenous Peoples with respect to the proposed tobacco cost recovery framework, and will engage and work closely with Indigenous governments, organizations, and communities to ensure the specific interests of Indigenous Peoples are carefully considered. What’s next?

Health Canada will review and analyze the feedback received to inform the development of the regulations which would be published in the Canada Gazette, Part II and in the First Nations Gazette at a later date.
