NOTICE OF PROPOSED LOCAL REVENUE LAWS AND INVITATION TO MAKE REPRESENTATIONS

 

THIS NOTICE is given pursuant to section 6 of the First Nations Fiscal Management Act (the “FMA”).

 

Ts'uubaa-asatx (the “First Nation”) proposes to enact the Ts'uubaa-asatx Water and Sewer Services Fee Law (North Shore Estates), 2023 (the “Proposed Law”).

 

DESCRIPTION OF PROPOSED LAW:  The Proposed Law applies only to the area of the Cowichan Lake reserve (No. 08350) outlined on the plan attached to this Notice, which area is being developed for market housing purposes under the name "North Shore Estates" Phases 1, 2,3 (the "Development").  The Proposed Law authorizes the First Nation to levy fees for the provision of water and sewer services to the holders of interests within the Development at rates that correlate with the rates set by the Town of Lake Cowichan (the "Town") from time to time for "outside users" pursuant to the Town sewer and water bylaws, except that during construction, for a period of six months or until an occupancy permit is issued, whichever is earlier, the fee for the provision of water will be levied at a rate that correlates with the single-family unit rate set by the Town from time to time pursuant to the Town water bylaw, plus a surcharge equal to 10% of those fees in 2023, and one percentage higher in each subsequent year until 2028 when the surcharge will remain at 15%. The fees to be levied by the First Nation pursuant to the Proposed Law reflect only a fraction of the projected cost of the First Nation in providing water and sewer services to the Development, as outlined in a fee law report prepared on behalf of the First Nation.

WRITTEN REPRESENTATIONS: The Council of the First Nation invites written representations regarding the Proposed Law.  If you wish to make a written representation, your written representation must be received by the First Nation at the address set out below on or before 5:00 pm, February 15, 2023.  Council will consider all written representations received in accordance with this Notice before enacting the Proposed Law.
