TZEACHTEN FIRST NATION

 

NOTICE OF PROPOSED LOCAL REVENUE LAW AND INVITATION TO MAKE REPRESENTATIONS

THIS NOTICE is given pursuant to section 6 of the First Nations Fiscal Management Act (the “FMA”).

The Tzeachten First Nation (the “First Nation”) proposes to enact the Tzeachten First Nation Property Transfer Tax Amendment Law, 2017 (“Proposed Amending Law”).

DESCRIPTION OF PROPOSED LAW: The Proposed Amending Law is made under the general authority of section 5(1)(a) of the FMA, and will amend the Tzeachten First Nation Property Transfer Tax Law, 2013 (the “original law”).  The Proposed Amending Law adds the following new paragraph (x) to Section 19 of the original law in order to provide for an exemption from taxation for a transfer of a lease to a Tzeachten member where, in respect of the transfer,

(i)  the Tzeachten member is the only transferee,

(ii)  all of the transferees are Tzeachten members, or

(iii)  the Tzeachten member and the Tzeachten member’s spouse are the only transferees,

provided that the transferee will hold the interest in land directly and not as a trustee, and the interest in land will be the transferee’s principal residence.

The Proposed Amending Law also adds a new section 19.1 to the original law, which requires the First Nation to pay into the local revenue account an amount equivalent to the exemption given to a member. 

 

A copy of the Proposed Amending Law may be obtained from the First Nation at the address set out below.

WRITTEN REPRESENTATIONS: The Council of the First Nation invites written representations regarding the Proposed Amending Law.  If you wish to make a written representation, your written representation must be received by the First Nation at the address set out below on or before 4:00 pm on January 14, 2018.  Council will consider all written representations received in accordance with this Notice before enacting the Proposed Law.
