NOTICE OF PROPOSED LEVY AND ASSESSMENT LAWS AND INVITATION TO MAKE
REPRESENTATIONS

 

NOTICE IS GIVEN that the Ermineskin Cree Nation proposes to enact the Ermineskin Cree Nation Levy Law and the Ermineskin Cree Nation Assessment Law pursuant to the  Ermineskin Tribal System Constitution and the Nation’s inherent rights recognized under section 35 of the Constitution Act, 1982 and the United Nations Declaration on the Rights of Indigenous Peoples (hereafter referred to as the “Proposed Laws”).

DESCRIPTION OF PROPOSED LAWS:  The Proposed Laws are a property assessment law and a levy law.  The property assessment law provides for the assessment and valuation of interests in the reserve lands of the Ermineskin Cree Nation, including appointing assessors, inspecting property, preparing assessment rolls, and mailing assessment notices.  The property assessment law provides a process for reconsideration of assessments and for a right of appeal to an assessment review board.  The levy law establishes a regime that imposes and collects levies in respect of interests in the Ermineskin Cree Nation’s reserve, and includes provisions for exemptions, grants, preparing levy rolls and levy notices, the levy of penalties and interest on unpaid levies, and the collection and enforcement of unpaid levies.  THE LEVY IMPOSED UNDER THE PROPOSED LAWS WILL NOT APPLY TO THE NATION’S CITIZENS OR NATION-OWNED (OR NATION-CITIZEN-OWNED) BUSINESSES.

COUNCIL OF THE ERMINESKIN CREE NATION INVITES WRITTEN REPRESENTATIONS regarding the Proposed Laws. 

Persons wishing to make a written representation must deliver the representation to: Sam Minde by email at samuel@ngcinc.ca. Before the Proposed Laws come into effect, Council will consider all written representations received in accordance with this Notice.
